BDA in partnership with McDermott Will & Emery, Norton Rose Fulbright, BALT and STEP Bermuda this webinar will explore creative (and sometimes counterintuitive) structuring techniques and review recent legal developments and their impact on U.S.-Chinese families with significant wealth in multiple jurisdictions. They will also discuss how “offshore trusts” interact with “foreign trusts” in U.S. planning and certain offshore jurisdictions that are emerging as Asian clients’ preferred jurisdictions.

The discussions will include the following key questions, to be illustrated with recent real-life cases:

  1. When is a foreign non-grantor trust a preferred structure for U.S. beneficiaries?
  2. Why is a foreign trust a terrible idea for certain wealth holding structures (think the wave of Hong Kong IPOs and pre-IPO planning)?
  3. How can the U.S. side of the family benefit the Chinese side of the family while minimizing U.S. income tax and avoiding pitfalls? U.S. green card holders and citizens’ different options.
  4. What is the current status of the CFC/PFIC attribution regulations and their impacts on U.S.-Chinese families’ investment and business holding structures?
